Website Terms of Service

These terms govern your use of KANETECH's public website. Paid client services are governed by a separate written agreement.

Acceptance of these terms

By accessing or using this website, you agree to these Website Terms of Service and our Privacy Policy. If you do not agree, do not use the website. If you use the website on behalf of a business or other organization, you represent that you have authority to act for that organization.

Informational website

The website provides general information about KANETECH LLC (“KANETECH,” “we,” “us,” or “our”), our approach, and potential services. Website content is not a binding proposal, guarantee, or professional advice tailored to your company. We may update, remove, or change website content and availability at any time.

Growth Assessments and contact requests

Submitting a Growth Assessment or other contact request does not create a client, fiduciary, partnership, employment, or agency relationship and does not obligate either party to proceed. KANETECH may accept or decline any request. Any engagement, scope, deliverables, timing, fees, ownership, confidentiality obligations, and responsibilities will be stated in a separate written agreement signed by the parties.

Communications

When you request an assessment or contact us, you agree that KANETECH may respond by phone or email about your request. If you separately and optionally consent to service-related text messages, message frequency varies and message and data rates may apply. Text-message consent is not a condition of purchase. Reply STOP to discontinue applicable messages or HELP for help. Your communications choices are further described in our Privacy Policy.

Services, pricing, and payment

Service descriptions, timelines, examples, and “starting at” prices shown on the website are general information and may change. They do not include every requirement, third-party cost, advertising spend, tax, or fee that may apply. A signed proposal or services agreement will control over this website if there is a conflict concerning paid services. The website does not itself complete a purchase or create a subscription.

No guaranteed outcomes

Search visibility, rankings, customer response, appointments, lead volume, revenue, and return on investment depend on many factors outside KANETECH's control, including market conditions, platform changes, competition, client participation, sales execution, budgets, and timing. Unless expressly stated in a signed agreement, KANETECH does not guarantee a particular ranking, number of leads, revenue result, or return on investment. Examples and past results are illustrative and are not promises of future performance.

Intellectual property

The website design, original copy, KANETECH names and marks, graphics, software, and other original materials are owned by KANETECH or used with permission and are protected by applicable intellectual-property laws. You may view public pages and share links to them for lawful business purposes. You may not copy, reproduce, modify, distribute, sell, scrape, or create derivative works from substantial website content, or imply an affiliation with or endorsement by KANETECH, without written permission.

Information you submit

You represent that information you submit through the website is accurate, lawful, and yours to provide. You retain ownership of your materials, but you authorize KANETECH and its service providers to use, store, reproduce, and process them as reasonably necessary to respond to your request, operate the website, and provide requested services, subject to our Privacy Policy and any applicable written agreement.

Acceptable use

You may not interfere with the website; attempt unauthorized access; introduce malware or malicious code; circumvent security or access controls; submit deceptive, unlawful, infringing, or abusive material; impersonate another person; harvest personal information; or use automated systems in a manner that unreasonably burdens, damages, or disrupts the website. We may restrict access when we reasonably believe these terms have been violated.

Third-party services and links

The website may link to or rely on third-party platforms, including analytics, customer relationship management, scheduling, communications, and hosting providers. KANETECH does not control and is not responsible for third-party content, availability, security, products, or policies. Your use of a third-party service may be subject to its separate terms and privacy notices.

Disclaimer of warranties

The public website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, KANETECH disclaims warranties concerning the website, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the website will be uninterrupted, error-free, secure, or complete. Nothing in these terms excludes rights or responsibilities that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, KANETECH and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising solely from use of or inability to use the public website. Liability connected to paid client services is governed by the applicable signed client agreement. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Governing law and venue

These website terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Any dispute arising solely from these website terms or use of the public website will be brought in the state or federal courts located in or serving Sedgwick County, Kansas, and each party consents to their jurisdiction. A signed client agreement may specify different dispute terms for paid services.

General terms

If a provision of these terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these website terms without our written consent. KANETECH may assign these terms in connection with a merger, reorganization, sale of assets, or by operation of law.

Changes to these terms

We may update these terms from time to time. The “Last Updated” date identifies the latest revision. Updated terms apply prospectively when posted unless applicable law requires otherwise. Your continued use of the website after an update means you accept the revised terms.
